Rummer died on January 16th.

The investigation began on February 4th.

Why did it take so long for the Sheriff to notify the DA's Office of the death?

 

 

 

 

 

 

4. Was he seen by medical personnel because of his delusions? Was he medicated? Were his delusions due to his medication?

 

6.What prompted the medical examination?

How long after his move to cell 423 was he seen by medical staff?

 

7. How much later after he was seen by the nurse did he begin behaving violently?

Again was he medicated?

9. Why was only one deputy entering the cell?

14. How aggressively was Rummer handcuffed?

15. Explain "took to the mat"

16. If the fall from the seated position to the knees aided in breaking the fall, how exactly did Rummer's head move fast enough to hit the padded mat with enough force to cause his injuries?

17. How was Deputy Hudson's body and hands positioned?

21. Was Gary Rummer conscious when he was taken to the Nurse?

22. When examining a head wound doesn't protocol require looking for signs of confusion or lack of consciousness?

What medication was administered?

Who was the physician who authorized the medication?

23. what exactly is the definition of "safe keeping"

24. Is cell 419 isolated?

Is it an infirmary?

25. How much later did the officers try to awaken Mr. Rummer?

When was the last time he was seen awake?

26. Why Central Prison and not the nearby New Hanover Regional Hospital?

30. Not beaten? What exactly does that mean?

32. Could injuries of that nature be consistent with multiple blows?

33. After the initial SBI report was delivered and studied, what caused a need to re-enact the actions of Deputy Hudson?

Why wasn't pathologist Glickman provided with an alternative to the re-enactment?

34.a. How long after the incident did Deputy Hudson do his re-enactment for the camera? How many times did Hudson do his re-enactment? Was the tape edited?

34.b. These are leading questions and prove nothing.

34.c.Again how many times did he do the re-enactment?

34.e. Was it an edited version of the tape? Was there audio on the tape? What size person was the actor portraying Rummer? Was the action in full speed?

34.f.Is it possible that someone could have been beaten and exhibit exact same injuries?

Could similar injuries be caused by a car accident? A fall from a ladder? A tackle from a 250 pound linebacker onto concrete?

34.g. Again if Gleckman was shown someone being tackled by a 250 pound linebacker could that also be consistent with the injuries suffered by Rummer?

35. Isn't the evidence of excessive force the injuries sustained by Rummer?

Would it be reasonable to assume that "taking (someone) to the mat" could be potentially injurious?

36. Isn't that for a jury to decide?

We beg to differ with the District Attorney, the law says that the use of a public record in connection with a criminal investigation does not alter its status as a public record and that a law enforcement agency cannot prevent another agency from disclosing a public record.

Until 1993 N.C. State Bureau of Investigation records were kept confidential by state statute.

That statutory provision has been repealed, however, and now the state Public Records Law applies to SBI records the same way it applies to all other law enforcement records.


Criminal investigation records are defined as "all records or any information that pertains to a person or group of persons that is compiled by public law enforcement agencies for the purpose of attempting to prevent or solve violations of the law, including information derived from witnesses, laboratory tests, surveillance, investigators, confidential informants, photographs, and measurements."

Final Comment:

The District Attorney's Office and State Bureau of Investigation had nearly 4 months to investigate the death of Gary Eugene Rummer and they are unable to tell us how the Pathologist, who completed the autopsy report, came to believe and make a note into his report's summation, that, "the decedent was a 50-year-old white male who was reportedly assaulted by police officers in Wilmington, North Carolina. When asked who gave Pathologist Aaron Gleckman the information that Rummer was "assaulted by police officers", Carriker stated that he did not know the answer to that question.
