DEATH PENALTY. ALAN GELL'S CASE MAY HAVE CHANGED THE WAY WE THINK ABOUT DEATH BY THE STATE

David Hoke and Debra Graves prosecuted Alan Gell. Graves and Hoke both worked for Mike Easley, Hoke was Easley's number one man, while Easley was Attorney General. Both Graves and Hoke with held critical evidence from the defense that would have acquitted Gell. Because of that corruption Gell spent 9 years in jail, many of which were spent on death row.


Now Gell is a free man and Graves and Hoke, who Easley recently described as "good people and good lawyers" faced the Bar and received a slight slap on the wrist.


Easley dismissed his involvement with the case recently but took credit for the prosecution's death sentence award when it was handed down.


Accountability starts at the top and ends there.
There are two men sentenced to die this month. Both seem like good candidates because of the heinous acts they perpetrated against their victims. But do we know everything?


Under Easley's watch Gell was sentenced to death. Which one of Easley's grandstanding convictions still await reversal on death row?


The human costs to Alan Gell and his family and to the victim's family, and the economic costs to citizens of North Carolina are enormous.


“The emotional and physical toll a travesty of justice like this must take on Mr. Jenkins’ family and on Mr. Gell and his family is impossible to quantify,” says David Neal, a spokesperson for the North Carolina Coalition for a Moratorium, a statewide group of organizations and individuals who support a temporary suspension of executions while we study our capital punishment system. “This is exactly why we need to take a step back, temporarily halt executions, and figure out what is going wrong in these cases.”


Last year the North Carolina Senate passed a moratorium bill and the State House will consider the bill in the upcoming session.


Gell is one of a growing number of men wrongfully convicted and sentenced to death in North Carolina. Jerry Hamilton was recently awarded a new trial because the state withheld evidence that points to his innocence. Charles Munsey was also awarded a new trial because prosecutors withheld evidence of his innocence; another man who confessed to acting alone was later convicted of the murder. Alfred Rivera and Tim Hennis were both sentenced to death, and like Gell, acquitted in retrials.


Twenty-one local governments, more than 1000 businesses, congregations, civic groups and organizations, and more than 40,000 North Carolinians have signed moratorium petitions. Every major newspaper in North Carolina and numerous smaller papers have endorsed a moratorium. Nine former North Carolina Supreme Court Justices have endorsed the moratorium, joining many other prominent North Carolinians such as Dean Smith, Herb Sendek, James F. Goodmon, Charles A. Sanders, and L.M. “Bud” Baker.

WHO IS (W)RIGHT? STATE HOUSE REPRESENTATIVE THOMAS WRIGHT HAS MADE SOME WRONG DECISIONS

Rep. Thomas Wright is having trouble recovering from allegations of selling his influence over a scandal regarding his receipt of $35,000 from the big drug companies lobbying group . 4.8 million dollars came to the N. C. Foundation for Advanced Health Programs Inc. as a result of an informal deal the pharmaceutical industry reached with key legislators to avoid state controls on expensive drug prescriptions for Medicaid patients.

In 2002 and 2003, state Rep. Thomas Wright, a Wilmington Democrat, received $35,000 in consulting fees from the N. C. Foundation for Advanced Health Programs Inc., a group controlled by the state Department of Health and Human Services.
Wright, co-chairman of the powerful House Appropriations Committee and former co-chairman of the appropriations subcommittee that oversees the department's spending, did not disclose the work on his statement of economic interest that all legislators must file. He said he didn't know the foundation, which gets about a $325,000 annual subsidy from the state, was associated with state government.

As if that sort of behavior isn't enough of a reason to vote against Rep. Wright's bid for re-election, we looked to see what kind of legislation Rep. Wright tried to push through and found two disturbing bills that are costly pro-crime that are extremely favorable to criminals.

Imagine a convicted child sex offender's record being expunged, wiped clean, as soon as he is freed from prison, Thomas Wright's House Bill 1190 would allow that to happen.

COMMENT... THE ASSAULT WEAPON BAN HAS EXPIRED

Weapons similar to the ones used to kill local UNCW student Christen Naujoks and recently used to threaten a Wilmington man. Travis Wayne Harper was arrested Sunday, September 12th at 2:47 AM for assault by pointing an SKS assault rifle in a manner to intimidate.

Assault weapons are rarely used in the commission of a crime. Statistics show that since the ban has been in effect there has been little change in usage. The concern is the killing power that the ammunition carries but the same ammo can be used in legal weapons.

The FBI says that one in five law enforcement officers that are killed are killed by an assault rifle. There is reason for debate on this issue but little to back up the over whelming statistics that the guns are not the problem.

INMATE RAPE


On September 5, 2003, inmate Timothy Daniel Locklear, 29 of Aberdeen, NC raped a fellow inmate
in his overcrowded cell. The 17 year old inmate was forced to do a sexual act by habitual felon Locklear at night in the Brunswick County Jail.
Two other inmates witnessed the act and testified in court that the 6'1" Locklear forced himself on the smaller 5'7" victim.

Although this type of male on male assault is rare in Brunswick County other male on male predatory crimes are not as uncommon. Fights, threats, intimidation and harassment are part of the norm both in Brunswick County and every other county jail. Most of these inmates are locked up for a reason, they are dangerous.
Overcrowding is a major proponent to inmate violence. Not enough "personal space," lack of open visibility by passing deputies, no means of segregating violent offenders from nonviolent offenders.

VIDEO POKER MONEY SOILS NC HOUSE

You would think lawmakers would obey the law. New findings show the influence of dollars on greedy politicians. Who is to say exactly how deep this influence peddling goes. The number one person being looked at is Wilmington businessman and owner of Southland Amusements, Robert E. "Bobby" Huckabee III, and how he perhaps spread the money around illegally. NC House of Representives Speaker, Jim Black has received $121,000 from video poker concerns, many of the contributors had no idea that they gave money to Black.

The Senate voted overwhelmingly to ban video poker and Black had it held up in the House while influenced House members tried to bargin their way into reversing or modifying the vote.Wednesday the House voted to reject the Albertson Bill which banned the machines and to send the Senate a new Bill wrought with controversay. At the very least the gaming industry bought a delay in legislation becaue the Senate will is certain to reject it.

OVERCROWDING NOTHING NEW

We have all known that the New Hanover County Jail is dangerously overcrowded. Inmates sleeping on the floor, chained to the walls while they await trial. This does not help fight crime, in fact it hinders all of law enforcement's efforts. This overcrowding causes, not only a loss of taxpayer money, but it quite possibly can be attributed to murders, rapes and numerous crimes against property and possessions. We can't keep the criminals locked up so we offer them deals to exit the system as fast as you can say "suspended sentence".

UNCW student, Jessica Faulkner, of Cary, North Carolina, body was discovered Wednesday a short distance down the hall from her own bed. Another student, Curtis Dixon had apparently forced Jessica Faulkner into his room and killed her. Dixon is charged with Murder, rape, kidnapping and sexual assault.

NEW HANOVER COUNTY SHERIFF'S DETECTIVES can take a deserved rest. Ever since Friday night the search has been on for John Peck, the accused killer of UNCW student Christen Naujoks. There is no doubt that several deputies have sandman encrusted eyelids pushing them to lay down and sleep. Hopefully they will get a chance to do just that soon.


Peck's actions makes us pause and think about the sorrow caused. Obviously the poor, heart struck Naujoks family and Christen Naujoks' friends are deeply soaked in grief. Less obvious of the sufferers are the neighbors who feel less safe now as well as those within the community of UNCW. There is also a group of lawmen in the mountains of North Carolina that are faced with sorrow, according to early reports Peck had gotten into a firefight with authorities at a roadblock before driving off a cliff. Those lawmen, just as all lawmen everywhere, do not want to be involved in a shooting incident much less one that ends in a fatality.

SHAMEFUL ACT

Norman Gattison,42, a deputy with the New Hanover County Sheriff's Office was arrested in January of 2004, for having sex with an inmate in his custody and charged with second degree rape. Gattison was fired from the Sheriff's Office and was just convicted in New Hanover County Court Superior Court and sentenced to a short six months in prison. Short prison terms such as the one Gattison received can be served in the New Hanover County Jail but Gattison has been transfered to Piedmont Correctional Institute in Rowan County.

OAKDALE CEMETERY VANDAL CAUGHT

SATAN'S SPAWN ARRESTED

Vandals desecrated about 100 graves in the historic Oakdale Cemetery over the weekend of October 10th. Easily over $90,000 of damages occurred. Most of the grave markers were irreplaceable, some date back to the mid 1800's.

The Wilmington Police Department's Detective R L Odham arrested Daniel Corey Benson, 22 (absolutely no relation) on November 2nd. Benson of 715 Olde Point Road in Hampstead has quite a lengthy criminal history with nearly 90 felony convictions yet Benson was not sentenced to active prison time. (more about this)

15 suspected dealers jailed
Complaints about open-air drug markets in Wilmington led to the roundup Friday afternoon of at least 15 people police characterized as street-level dealers.
Thirteen men and two women were picked up by the city police Narcotics Enforcement Unit during "Operation Strike Zone," with more arrests anticipated, Sgt. Jeff Allsbrook said.
Police responded to citizen complaints about drug activity in various city neighborhoods and used undercover agents to purchase crack cocaine, heroin and marijuana over a two-week period. Sgt. Allsbrook said some of the busiest street corners were Creekwood Road and Maides Avenue, 12th and Chestnut streets, Eighth and Queen streets and Nesbitt Court.

Aziya McLaughlin

17 year old Aziya McLaughlin died because she was mortal. Although, to many who knew her, she was beyond human. She could do anything it seemed, including talking her ex-boyfriend out of killing himself, taking his gun from him and throwing it into the river. Little did Aziya know, her seriously disturbed ex-boyfriend obtained a stolen gun soon after that and repaid her heroic act of saving his life by shooting her three times as she stood in her driveway early Monday morning. Aziya McLaughlin is no longer mortal, she is an Angel, just as everyone who loved her knew her to be.

We didn't know Aziya, but we recognize her spirit and we are sad for all who knew and loved her.

How can we prevent this from happening again? Get involved, get educated about domestic violence and be aware. Men in particular, should not tolerate comments or acts by other men that reinforce feelings of jealousy or anger related, possessive attitudes toward women.

But most importantly remember that most people who are murdered are killed by people close to them, people they knew. Get to know your friends and lovers better and if there is a concern, act on it immediately.

BAREFOOT CAUGHT!

MAN AND WOMAN BOUND AND ROBBED IN CUMBERLAND COUNTY . ESCAPEE BELIEVED TO HAVE COUPLE'S RENTAL CAR.

William Barefoot, a 44-year-old white man, is considered armed and dangerous. He was being held in the Hoke County jail, where he was awaiting a hearing on charges unrelated to Barefoot's 2002 conviction for attempting to murder a law enforcement officer.
According to reports, the 200-pound, 5-foot-11-inch Barefoot overpowered two officers and locked them in his own cell. He stole a white Ford Explorer belonging to one of the detention officers, later wrecking it in Moore County while being chased by Aberdeen Police.

WHEN TERRORISTS ATTACK

Terrorism Addressed at Carolina Beach

Marc Benson addressed the members of the Carolina Beach Police Advisory Committee Tuesday night about potential Terrorist threats and the need for preparedness. The talk made an impression on the committee for the need to train and furnish the first responders with proper materials and supplies for the security of the residents and visitors of Carolina Beach.
Although Carolina Beach is an unlikely target, Benson pointed to the latest intelligence reports that Al- Quaeda is focusing on smaller targets in order to strike at the fear of America's Heartland. The Island's immediate proximity to the Progress Energy Power Plant, Sunny Point's Military Depot and the dependency of the Island of a functional Snow's Cut bridge for the evacuation and accessibility of emergency personnel in the event of a terrorist disaster.
Committee member Randall Simon made a suggestion to Carolina Beach's acting Police Chief, Major Bill Still, to look into the resources necessary to protect the first responders. Another suggestion was made by the committee to try and coordinate with the Emergency Response Team to develop a plan to deal with a terrorist attack.
Benson closed his comments by saying that "it is better to have a plan of action in place and not need it than not have one and lose lives." "The world will be watching should something happen, and you want to be prepared."
In the audience councilman Jack Lynch stood up and addressed the committee to acknowledge Benson's enlightening remarks and pledged to investigate the Island's shortcomings of preparedness.

Sidbury Road residents, Jasper Gary Newell and Melody Newell, were arrested by New Hanover County Sheriff's Detectives on various charges stemming from a lengthy investigation by the Department of Social Services,into the reported rape of a child that lived in their home. Allegedly Mr. Newell, the 15 year old child's step father, has admitted to the rapes, that continued repetedly, over the past ten years. Incidents of child sexual abuse have become much more commonplace.

In 1999, Bald Head Island Police Officer Davina Buff Jones' body was found near the lighthouse with a gunshot wound to the head.

N.C. Industrial Commission Deputy Commissioner Adrian Phillips called the case a homicide, disputing a multi-agency investigation that ruled Ms. Jones' death a suicide.

"The disturbance of the site where the decedent's body was found and the disturbance and contamination of the crime scene make it impossible to make a definitive showing that the manner of death was suicide," Ms. Phillips wrote in the ruling.

DEADLY INNOCENCE

JOHNNIE BECK

Johnnie Beck's identical twin, Ronnie, was jumped and stabbed three times in the chest seconds prior to the attacker turning his insane rage upon Johnnie, and slicing off half of Johnnie's left thumb. Quick thinking Johnnie shot his and his brother's attacker in the chest while being assaulted with deadly force. This deadly fight took place in the parking lot of a Burger King in Whiteville, NC the evening before Thanksgiving 9 years ago. Johnnie Beck was charged with First Degree Murder because he fired twice to kill the attacker. Beck was later convicted of Second Degree Murder and has been denied appeal. He is currently serving a 12 year sentence. Ronnie Beck, the twin brother, barely recovered from his injuries.

The Brunswick Beacon reported on Wednesday, November 3rd, that District Attorney Rex Gore wants to overturn a conviction of a man charged with child rape. Sylvester Smith, 53, has been in prison for 20 years. On Friday, Smith won his motion and the case was dismissed. Now the news is international. Over 179 news organizations are carrying the story. Perhaps there is hope for Johnnie Beck. Smith was released because witnesses have come forward, Beck also has witnesses that offer new evidence. Both Beck and Smith have Rex Gore as District Attorney.

Alan Gell spent 9 years behind bars, 7 of them on Death Row, for a crime he did not commit. This was not mistaken identity, or a lack of conclusive DNA evidence. This was the direct result of prosecutorial misconduct. by the North Carolina Attorney General's Office. Gell was freed in February, 2004, when it was discovered that the Attorney General's Office with-held evidence that proved Gell was not only out of town when the murder took place, but he was in jail in another State for a separate crime. Not only that but the State hid evidence of a tape recorded phone conversation, in which the State's two star witnesses admit to lying about Gell's involvement in the murder.

Alan Gell is on a mission to educate young teens and college students about the lessons he has learned about justice. Who better to speak to those at risk than Alan?

GRANDFATHER AND GRANDSON SENTENCED TO DEATH 18 YEARS APART

Paul Cummings and his grandfather Jerry Cummings both sit on Death Row awaiting execution. Grandpa Jerry was sentenced in 1987 and grandson Paul in 2004. Bassam Mansour, of Windchime Dr. in Wilmington, was arrested for corruptly seeking and accepting something of value and committing a fraud on the United States, according to documents filed in federal court.

One of the recipients of Mansour's actions may have been the Islamic Center of Wilmington.

Mansour is a civilian official at the Military Ocean Terminal at Sunny Point. Sunny Point is the only East Coast port for shipping military equipment, including ammunition and weapons, overseas.

Mansour's arrest poses a serious question regarding National security. In a day and age when an alarm goes out when someone is seen photographing a refinery, how much more of a risk is there when someone is taking money illegally, setting a precedence for further corruption at one of the Country's largest shipping terminals for munitions.

Mansour was immediately released, from federal custody, on an unsecured bond.
